Summary

As Plaintiff lawyers, we’re more familiar with defending against Motions for Summary Judgment/Adjudication than we are with bringing them affirmatively. It can be difficult for a Plaintiff to “win” the case at the MSJ stage. However, filing an MSJ/A in your case can be a great offensive tool to flush out Defense evidence and expert testimony, lay the foundation for key Plaintiff arguments, and, if successful, narrow the issues at trial.
