Summary

HIPAA/HITECH regulations that went into effect October 6, 2022, require healthcare providers and other "Actors" to comply with the 21st Century Cures Act (Cures Act) by providing to the patient or the patient's designee a complete set of electronic medical records, "the designated records set," upon request. Any act or omission that blocks or delays the patient's access to their own electronic medical records is a violation of the Act and is termed "information blocking."

Roger Leslie will cover the steps needed to obtain copies of electronic records under the Cures Act and details of how to report violations to Health and Human Services. As an example of how the Act is still being violated, he will share his experience of being billed by CIOX for copies of his own medical records, provided to him by his clinic and downloaded for free from a MyChart webpage.
