Summary

The Chapter 11 bankruptcy filing by the Center for Special Needs Trust Administration, Inc. (CSNTA), one of the largest pooled special needs trusts in the country, raises questions for attorneys representing clients with special needs trusts. Then, there is the class action alleging breach of fiduciary duty, negligence, violations of the Florida Uniform Fraudulent Transfer Act, and unjust enrichment by CSNTA founders, entities they control, and other individuals and defendants who did business with them. Where does all of this leave beneficiaries of the pooled needs trust?

This webinar will address the actions that led to the Chapter 11 filing, potential warning signs, complaints that formed the basis of the class action, what this means for your clients, how to advise your clients with a special needs trust managed by CSNTA and whether special needs trusts are appropriate for your client, given these circumstances.
